The bailiff at the time of confinement

Containment began this morning. We are reliving the situation of last spring, resigned. However, the majority of the bailiffs have organized themselves in anticipation of this reconfinement. Small points in the form of questions and answers.

Do studies remain open during containment?

Of course, our answers are for our study only and we cannot speak on behalf of our confreres. Our two studies, 6 place Tristan Bernard in Paris 17th and 12 avenue du général Gallieni in Nanterre remain open and available. Of course, we will favour teleworking for our collaborators, with a reduced but real presence in the offices. Also, we invite you to favour telephone contact, if only to avoid unnecessary travel.

Do you continue your missions of significance?

The service of judicial and extrajudicial documents is a public service delegation. As such, and in the interest of Justice, we pursue our service missions throughout the Paris region (Paris and Versailles Courts of Appeal). Obviously, we will give priority to contactless service of documents. This is a continuation of what we have been doing since March in order to prevent the virus.

Can we send you new documents to be served?

The teams remain mobilized to provide an effective response to your requests. There should be no change in the service provided to you. The generalisation of teleworking has been tried and tested for several months. There are no technical obstacles that could affect the service.
For the sending of documents, we invite you to give preference, if only for health reasons, to sending them dematerialised, by e-mail for example or via the Delivract platform.

What is the Delivract platform? What is it used for?

Delivract is an entirely free platform, intended for lawyers, legal directors, institutions and, in general, any person who has acts to address to judicial officers. Registration is done through our office, which will provide you with a code allowing you to access the service immediately. On this platform, you can deposit your documents, indicate the names and addresses of the persons to be served with them and automatically, Delivract seizes a territorially competent bailiff, or several bailiffs if your document is intended for several litigants. You have an integrated messaging system that allows you to communicate directly with the office or offices, and retrieve the served document directly online.

What if I have papers to serve abroad?

Our international service of service works smoothly and our partners, particularly in Europe, continue to serve documents, so that you can send us your documents to be served abroad.

Do you make observations during containment?

Insofar as an observation is necessary to report the reality of a fact or a situation, we continue our observation measures. However, and as has been the case since March, these observations are made while wearing masks for all those present, whose number is reduced to the strict minimum. Will you continue the forced enforcement of court decisions?

Les mesures d’exécution coercitives ont été suspendues durant le premier confinement. Il nous semblait de notre devoir de suspendre en effet les mesures les plus contraignantes. Cette fois encore, nous ferons preuve d’humanité en étant particulièrement à l’écoute des difficultés rencontrées par les personnes que nous serions amenées à poursuivre, et notamment les commerçants « non essentiels » qui subissent une fermeture administrative. Aussi, les appelons-nous à prendre contact avec nous  pour exposer leurs difficultés et trouver, dans le dialogue, des solutions. Nous insistons sur cette nécessité de prendre contact avec notre étude.

I am the recipient of a document that you filed in your office: can I come and get it back?

Travelling on a public service is a case of authorized travel waiver, so you can travel in our study. However, the bailiffs provide two services free of charge which can save you unnecessary and sometimes distant trips:

• We can transfer the copy of the deed to a study closest to your home, saving you a trip to Nanterre or Paris. All you have to do is send us a request by e-mail, specifying the name and address of the office where you would like to pick it up. You can even, if you are confined to the countryside, ask for this document to be sent to the office closest to your place of residence.
• You can choose to be made an addressee of the documents in an electronic and dematerialized way. All you have to do is fill in the form you will find here
