Reform of the Bailiffs' Tariff: What's changing
The so-called Macron Law modified the tariff of the bailiffs, reducing most of the costs of the acts and fees.
Without going into detail, act by act, here are some essential points about what changes and what does not change:
What changes:
Les coûts des actes ont tous été diminués d’environ 2,5%
Les tranches des droits proportionnels ont également été révisés à la baisse.
Le droit proportionnel article 10 prévoit une tranche supérieure
Les honoraires « article 16-1 » ont été remplacés par un triple mécanisme :
– des honoraires pour la redaction des actes d’assignation et de congé
– des honoraires d’urgence fixes pour les assignations, les significations de décision de justice notamment
– des suppléments de rémunération au temps passé pour les actes nécessitant plus de temps que ce que le législateur a estimé prévisible.
What doesn't change:
Free fees for services not subject to the tariff
The maintenance of all the elements composing the tariff
The evolution of the cost of the act according to the pecuniary obligation (by multiplying coefficient)
The findings have a free tariff
