View Building Permits: What's changing

building permit displayThe decree of 30 March 2017 reflects the obligation under the LCAP law. This decree makes it compulsory to display the name of the architect in charge of the construction, extends the period of expiry of planning authorisations to 3 years, and limits the number of copies of planning authorisations to two additional copies for prior declaration files.

The name of the architect must now appear on the notice boards of building permits (the same applies to development permits), pursuant to the LCAP law of July 7, 2016 and following the publication of the decree of March 30, 2017 published on April 12, 2017.

 

Article L650-3 of the Heritage Code : The name of the architect author of the architectural project is displayed on the land with the planning permission issued by the competent authority.

Article A424-16 of the Town Planning Code : The sign provided for in Article A424-15 indicates the name, business name or corporate name of the beneficiary, the name of the architect author of the architectural project, the date of issue, the number and date of posting in the town hall of the permit, the nature of the project and the surface area of the land as well as the address of the town hall where the file can be consulted.

 

In addition to the modifications concerning the name of the architect, the text now provides for the date of posting of the planning permission in the town hall to be mentioned, in order to secure the starting point of the time limit for appeal and to simplify the appeal of third parties.

The decree also includes other measures aimed at simplifying and harmonising the provisions of town planning law:

  • The expiry period of planning authorisations is increased to 3 years in Article A 424-8 of the French Urban Planning Code in accordance with Article R. 424-17 as amended by Decree no. 2016-6 of 5 January 2016. This period may now be suspended in two cases: in the event of an appeal against the permit or, in the event of an appeal, a decision provided for by related legislation giving rise to the postponement of the work until it has been obtained.
  • Article A431-9 of the Code de l'urbanisme no longer requires that two additional copies, as opposed to 5 previously, prior declaration files. On the other hand, the number of additional copies for building permits remains at 5.
