The judicial officer's statement of facts: a decisive element to prevent disputes and to prove damages

The judicial officer can avoid disputes thanks to the reliability of his statements of facts. The bailiff's statement of facts is a valuable means of proof, recognised by the courts and insurance companies:

The judicial officer intervenes to note the conditions of holding a general assembly, the progress of a trade union poll, the deposit of a regulation of a commercial lottery and a contest game, the reality of a posting of town planning permits, the state of a building, the existence of a defect?
Anything that harms the activity of the company and causes it a prejudice can be noted by the judicial officer.
Examples: the non-respect of a payment deadline, the effects of a strike, the state of a building site, the non-conformity of a service, unfair competition or counterfeiting.

To attest to the transmission of information

The date of dispatch of a registered letter is certain. But what happens to its date of receipt if the addressee does not pick it up or refuses it?
Only the service by a bailiff authenticates the date of receipt.
It is the best way to guarantee the indisputable character of the handing-over of a document on a given date and to a specific person (rental leave, dismissal, summons...).

In the company, the advice of the judicial officer is essential for the drafting of contracts and leases. His intervention is very reassuring for the delivery of deeds of assignment, revision, cancellation or renewal of leases.

Non-payment is not inevitable, but involves a cash flow risk that the contractor must avoid or limit.
Acting without any other intermediary, and through his authority and rapid action, the bailiff reduces the risk of financial losses for the company and guarantees the probability of payment. He thus contributes to the durability of the companies.

Its active presence in the field and its knowledge of the economic fabric enable it to adapt its action as well as possible. Depending on the nature of the unpaid amount (invoice, cheque, bill of exchange, acknowledgement of debt), it proceeds by way of amicable or judicial collection, and in the latter case, it is empowered to take an enforceable title (order for payment or summons). It manages emergencies in the best possible way by taking guarantees (precautionary measures) on the debtors' assets. It implements the most appropriate procedures (seizure of earnings, seizure of bank assets, seizure of movable and immovable property, etc.).
