The law n° 2000-614 of 5 July 2000 relating to the reception and housing of Travellers provides that the municipalities participate in the reception of Travellers, and that the departments provide for a departmental reception scheme, in which all municipalities with more than 5,000 inhabitants participate. However, in the absence of a solution, it is not uncommon for Traveller communities to invest illegally in a piece of land, whether public or private. In this case, it is better to have what to do in order to quickly arrive to the expulsion of Travellers.

We tell you what to do when you realize that they are investing in your land.

The first thing you have to do to start a procedure to expel Travellers:

React in an emergency by immediately contacting a bailiff in order to have the presence of the caravans noted, on the one hand, but also the presence of possible traces of assault that allowed the nomadic community to settle on your land (gate broken down, cut-out fence, uncontrolled installation of electrical diversion or access to water etc...). During his report, the bailiff will also be able to obtain the identity of the people on the spot;
On this last point, let us recall that the bailiff is not invested with police means allowing him to carry out an identity check, but he is used to defuse conflict situations and to spontaneously obtain the identities of the Travellers he meets.

Thanks to this report, you will be able to summon the occupants to court. Our study will help you in this process, of course.

From then on, the legal machinery is set in motion and the judge will issue a decision ordering the eviction from the community squatting your property.

Once again, the bailiff will go to the premises to serve the judicial decision on the occupants without right or title, and will order them, by means of a command to leave the premises, to vacate.

In the absence of voluntary departure at that time, the bailiff shall request the Prefect to the granting of law enforcement in order to expel the community from the trip. This public force may take the form of a simple police or gendarmerie crew for the simplest situations, or of several CRS or mobile constable companies for the most important situations.

Our study is well versed in this practice because we intervene on the Illegal occupation of land by travellers in the departments of Yvelines, Hauts de Seine, Val d'Oise and Eure et Loir.

Thanks to this experience, we are aware of the need to carry out the procedural steps quickly, but we also frequently negotiate early departures in order toget squatters out quickly even before the procedure for expelling Travellers has been completed.

Let us recall that there is no winter break for the expulsion of Travellers.

To start the procedure, we are at your disposal. You can ask for a report of occupation by travellers, very easily by clicking on this button:
